Privacy policy and use of cookies
Your provision of personal data is voluntary, however, it is necessary for certain purposes, such as the conclusion of a sales contract. Your consent to the processing of your data for additional purposes, e.g. marketing, is fully voluntary and does not affect the possibility of fulfilling the contract. You have the right to update or completely delete your personal data at any time.
The basic legal acts governing the protection of personal data include:
1. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU.L.2016.119.1) - hereinafter referred to as the "RODO",
2. the Act of 10 May 2018 on the protection of personal data (Journal of Laws 2019 .1781, i.e.), which is the implementing act for the aforementioned Regulation.
Our company adheres to a restrictive Data Protection Policy. Your personal data is safe with us and we make every effort to increase this level year on year.
I. Personal Data Administrator
The administrator of your personal data is Rafał Mirek, conducting business activity under the firm FHU GastroProdukt Rafał Mirek z/s in Olkusz ul. Żuradzka 29.
II. Purposes of personal data processing and legal basis.
We process your personal data for the following purposes:
1. for the purpose of concluding and duly performing a sales or service agreement (legal basis: Article 6(1)(b) RODO). This applies in particular to the processing of orders, payment processing, delivery of goods and contact in connection with the performance of the contract.
(2) In order to comply with the Administrator's legal obligations, arising in particular from tax legislation and the Accounting Act (legal basis: Article 6(1)(c) RODO). This applies, for example, to the issuing and storage of invoices and the processing of complaints and warranty claims.
3. for marketing purposes, including the sending of commercial information (Newsletter), which is done exclusively on the basis of your voluntary and express consent (legal basis: Article 6(1)(a) RODO). The detailed rules for obtaining and withdrawing marketing consent are described below:
(a) How consent is obtained: Consent to receive commercial information by electronic means (e.g. email) can be given by you by ticking the relevant optional checkbox when placing an order, creating an account or by completing a dedicated Newsletter subscription form.
b) Scope of consent: By giving your consent, you accept to receive commercial information on the GastroProdukt.co.uk shop's offer to the e-mail address provided.
c) Right to withdraw consent: You have the right to withdraw the consent you have given at any time. You can withdraw your consent by clicking on the opt-out link ("withdraw consent") included in each marketing message or by sending a statement to our email address. The withdrawal of consent does not affect the lawfulness of the processing carried out before the withdrawal.
4 For the purposes of the Administrator's legitimate interests (legal basis: Article 6(1)(f) RODO). This concerns the possible establishment, assertion or defence of claims, as well as the conduct of statistical analyses for internal purposes.
III. Recipients of personal data
The categories of entities to which data may be transferred include: banks, accounting and bookkeeping offices, IT service providers, courier companies, logistics companies, payment institutions, carriers, law firms, and - if you have given the appropriate consent - analytics and advertising partners (e.g. Google).
IV. Transfer of personal data to third countries - outside the European Economic Area.
Data will not be transferred to a third country - outside the European Economic Area or to an international organisation.
V. Period of storage of personal data
The storage period of your personal data depends on the purpose for which it is processed. We endeavour to keep your data only for as long as absolutely necessary.
1. performance of the contract and assertion of claims: We store the data processed for the purpose of concluding and performing the contract for the duration of the contract and until the expiry of the limitation periods for claims relating to the contract (in principle up to 6 years from the date of performance of the contract).
2 Legal obligations (accounting): We are obliged to keep the personal data contained in the accounting and tax documentation (e.g. VAT invoices) for the period required by law, i.e. for 5 years, counting from the end of the calendar year in which the deadline for payment of the tax related to the transaction has expired.
3. marketing (Newsletter consent): We will retain the data processed on the basis of your marketing consent until you withdraw this consent, but no longer than necessary to fulfil the purpose.
After the indicated periods, your personal data is permanently deleted or anonymised, i.e. a process that makes it impossible to identify a specific person.
VI. Rights of data subjects. Access to personal data
Under the terms of the provisions of the RODO, you have the right to request from the controller:
1. access to the content of your personal data,
2. rectification (amendment) of your personal data,
3. erasure of your personal data,
4. restriction of the processing of your personal data,
5. portability of your personal data,
6. the right to object to the processing of your data.
VII. Right to withdraw consent
If the processing of your personal data is based on your consent, you have the right to withdraw your consent. The withdrawal of consent does not affect the processing of your data until it is withdrawn.
VIII. Right to lodge a complaint with a supervisory authority
When the processing of your personal data violates data protection regulations, you have the right to lodge a complaint with the supervisory authority, which is the President of the Office for Personal Data Protection.
IX. Information on the requirement/voluntariness of providing data and the consequences of not providing personal data.
Your provision of personal data is voluntary. However, we stipulate that failure to provide personal data may prevent the fulfilment of orders placed.
X. Profiling
As a general rule, your personal data is not subject to automated decision-making which produces legal effects on you. However, in order to provide you with personalised content and advertising, we or our partners (e.g. Google) may use data collected via cookies to create a profile of your interests.
